Am I Owed Pay for Notice Period?
Kell A. Simon

Q.

I gave two weeks notice to my employer and was told to clear my desk and leave immediately. As I gave two weeks notice as the correct thing to do, and then not permitted to work Am I entitled to pay for those two weeks notice?

A.

You are not entitled to pay for those two weeks notice. Your employer does not have to accept your notice, and could even terminate you without warning at any time during your two week notice period.

One possible exception to this rule is that if your employer has a policy that says they will pay employees during a two-week notice period, then you may be able to have a state agency (generally it would be the same one that administers unemployment benefits) order the employer to pay you for the two weeks.
